We have had a very extensive 504 plan since diagnoses, and have had to get the USDE involved a couple of times to enforce it. Since then, they abide by it very well.

Crystal, My school district keeps telling me that the board is trying to take things away...like the kids won't be allowed to carry supplies...etc...the current theme is don't ask don't tell.

IHP is not the same as a 504 plan. The IHP is the nursing care plan developed by your school nurse/school. Does not have the legal effectiveness of a 504.

We are the case in TN that was confusing mitigating measures.. We had the help of Scott Richardson. We filed a class complaint with OCR after we were denied a 504 twice. Thanks to his help, not only did we get a 504, but 169 other students are being looked at in our county also

Karen, the risk you run is if school district has a policy and your child is found to be violating it. Your choice, but I recommend full disclosure and writing your child's ability to carry into his 504 plan.

Does everyone know the term "OCR"? It is a division of the U.S. Dept of Education that enforces Section 504.

Is the private school religious affiliated? Religious affiliated schools have no obligations under 504 or ADAct unless federal funds are received.

I havent heard an update lately. The district has till the end of Sept to retrain their 504 coordinators, and till the end of the year to re eveluate the students. i havent heard of anyone having issues lately getting one around here, or surrounding districts

Crystal, although I know the answers already, there was an email to the parents list today that had some good questions about the excuses the school nurse was giving them for not allowing their child to test in class. If you wouldn't mind answering them, I think a lot of parents could benifit from the answers. I will paste it if you want.

If your child attends a religious affiliated school that does not receive federal funds, I recommend that you check to see if it has an anti-discrmination policy and show the school how it is violating its own policy by failing to provide appropriate care and accommodations for your child.

I have it in there, thanks to you!...this year they took out the nurse accompanying Nick on field trips....they said if the parents can't go ...Nick shouldn't. But the head nurse is a friend of mine..she said so many parents just don't care. Right now..Nick has to walk a distance to the nurses office for testing....he's 11. She told me to pick my battles carefully , because Nick has his supplies with him all the time, and they are trying to get away from that. They want all the supplies in the nurses office.

Would love to hear more about school nurse reasons for not supporting classroom bgm. I know that the National Assn. of School Nurses supports classroom bgm for kids who are able to self-check and this is ADA's position as well.

I am trying to get the school to allow this and of course my school nurse is giving me every excuse in the book like:
- its against the law
- it endangers the other children
- its unclean
- its not age appropriate (she is 10 years old)

Requiring parent to go on a field trip is clear violation of 504. Individual assessment needs to be done to see if child is mature enough to carry supplies. Schools cannot have a blanket policy.

School nurse re: classroom bgm. Need to provide her with education resources from ADA and NASN. Which law is it against? Certainly does not endanger other children unless another child grabs a lancet and that's the school's problem. Not the yours. It is maturity, skill, and willingness that counts - not age. My goodness my daughter was checking in the classroom at age 8.

Our school tried to make Paige go to the nurse to check at first, we quickly stopped that concern and showed them how easy it was for her to do it in the classroom.

Bottom line is that kids who are able to do so should be able to self-check anywhere, anytime. If they can perform the skill, read the result, interpret the result, and appropriately act upon the result then he or she should be allowed to check in the classroom.

It is very rare to hear about resistance to classroom bgm anymore. It is widely supported by the diabetes healthcare community. Give this nurse good resources - the NDEP school guide, ADA postion statement, a letter from the child's provider. Write it into the 504 plan. This is a very basic accommodation.

We are in Pennridge district...apparently our board has called Central Bucks, and North Penn...2 of the biggest in Pa....and they are trying to reduce the risk of kids having the supplies on them. I asked them what would happen in the case of a lockdown...a point you raised to us years ago.....they had no comment...that's when my friend said that Nick has his things with him now,,,basically don't rock the boat. They took the cell phone out of his 504 and now he is alone on a field trip unless one of us goes.

Not every child is ready and capable to check in the classroom. It needs to be individual assessment by parent and health care provider with input from the school nurse.

Karen, I used to live in Bucks and know some people there. Let's work with Bd of Supervisor Diane Marseglia to make sure policy doesn't go in this direction. She is a good friend of mine. We can fix this by changing policy.

Older kids who can provide own care should be able to access cell phones to talk to parent and hcp about diabetes management issues. Write it into your child's 504. Need to priortize what accommodations are needed to meet your child's needs. Pick and choose your battles carefully.

No having type 1 isn't an automatic qualification for 504. 504 regulations require individual assessment. Historically, to the best of my knowledge, children with diabetes have been found to be 504 eligible.

we have 2 nurses for 4 schools, however Paige's teacher, para, and secretaries have all been trained in her management

For CGM we need to make sure that school staff knows what it is. knows what the alarms mean, knows that reading need to be confirmed with a finger-stick before treatment.

I wear a cgms, but it isnt written in my care plan. The school knows that I have it, what it does, and that it may alarm.
I willbe in college be next year and am looking for info on my rights at college. Does it matter if it is a private college?

Just so everyone knows, WA state has a law that allows parent to designate a school staff member to provide care. The school nurses took themselves out of the loop. The reality is that some teacher's unions are advising teachers not to step up to the plate. We need to find out where this is coming from and stop it.

If college receives federal funding, then 504 applies too, but the school's legal obligations are very different from elementary and secondary schools. Also, the student must self-advocate and initiate the 504 process which means going to the college disability office and getting on file and figure out what kind of accommodations are needed.

All parties must be in agreement with and sign a 504 plan to make it valid. It is ok to sign if there are outstanding issues, but make sure to indicate in writing on the plan the points of disagreement and how/when they will be resolved.

I have over three letter's from the doctor one he personally wrote and nothing they are still aying no to testing and that she would now be a distraction! we went from burden to distraction.

Federica - need to do a pump in-service for your contractd nurses. Contact your child's pump company who should be willing to do it free of charge. This is one way we can be a resource for our schools.

I have a quick question: My son goes to a religious school...they do get federal food sullies, but no funding. They would do a "Health Care Plan" but wouldnt do a 504. Is that OK?

There were 4 times last year when the nurse was either out or had to leave early...the back up person was the principal....and she was also out....they gave me the option of taking Nick out of school for the day or time period. Believe me, I did just that!

A burden and distraction is not a valid objection. Sounds like they are in dire need of education about diabetes and about legal obligations under federal and Texas law. Have you filed a complaint with OCR?

Karen, your child should not miss school because of your school's lack of trained personnel. Write it into your child's 504 that a trained staff member must be available at all times. Period.

Again, I have.and it is......when they have no one left, they call me to either come and sit there, which I can't always, or come get him. It seems very loose...there is a teacher there who is type 1, however, she is the one who told him a pack of smarties was 15 carbs...

Karen, I know this may seem difficult and this certainly is your choice, but you may want to take a stance and tell them that your child is staying in school and you are not coming to get him or keep him out of school. I know that approach is tough on us parents and wouldn't advise if child was faced with imminent danger, but it is the school's responsibilty - not yours - to provide care to your child while he is at school and/or participating in school-sponsored activities.

It is hard...these people act like we are overreacting..He went on the bus for reading olympics with no one...I followed like a crazy person...but sometimes, I think they feel that since it is such a short ride, or only a few hours...they just don't seem to get it...and then we are faced with the parents who don't even keep insulin at school...in the same district...so....we look like over zealous parents....

I have glucagon at school, but no staff has actually been trained yet. Some of my friends know how. School said they would have 2 people trained, but never did. I had a teacher volunteer/be volunteered to learn because I said I would feel safer on our sr class trip if an adult knew what to do.

Karen, you are absolutely in the right. But you shouldn't have to follow on a field trip. School must provde trained school staff member to go along on the trip. Smart school districts accommodate by training their bus drivers.

ADA recommends periodic refresher trainings. My school district gives refreshers several times a year and also when a trained teacher goes on a field trip.

Toni, individual assessment is required by the regs. It benefits the school to have your child take a test when bg levels are within target range. High test scores = school performance objectives being met. Recommend that you explain to the school how everyone benefits.
