California Law Guarantees In-Classroom Testing

On October 8, 2003, California Governor Davis signed into law an act (Assembly Bill 942) that will permit pupils in California to test their blood glucose level and provide diabetes self-care in any area of the school grounds, during any school-related activity or, if requested, in privacy. This guarantees students' rights to remain in the classroom for blood glucose testing and insulin injections if they desire to do so. The law also allows (but does not require) local school districts to permit volunteer school staff (other than nurses) to administer glucagon after proper training. Many school districts had previously alleged that state law prevented them from allowing anyone other than a nurse to administer glucagon, so this is a welcome clarification. This law should make it much easier for California parents to get testing in the classroom and emergency administration of glucagon included in their 504 Plans.
